FinTree Education Private Limited, a company incorporated under the provisions of the Companies Act, 1956 and having its registered office at 2 - 207, Second Floor, Ashok Sankul, above ICICI Bank, Bhoslenagar, Ashok Nagar, Pune, Maharashtra 411020 (hereinafter referred to as “FinTree”, “Company”, “we”, “us” or “our”, as the context may require), owns, operates, and manages an integrated education and learning ecosystem comprising websites, digital platforms, learning management systems, mobile applications, application programming interfaces (APIs), and other technology-enabled interfaces (collectively referred to as the “Platform”).
The Company operates under the brand name “FinTree” and/or such other brand names as may be communicated by the Company or its group entities from time to time. These Terms of Use (“Terms”) govern access to and use of the Platform and the Educational Services by any person who accesses, visits, browses, registers on, or otherwise uses the Platform, whether or not such person purchases, subscribes to, or enrols in any Educational Services (each, a “User”).
Through the Platform, FinTree facilitates and provides educational and professional learning programs across various subjects and disciplines, including but not limited to the Chartered Financial Analyst (CFA) course and such other academic, professional, certification, or skill-based courses as may be introduced by the Company from time to time.
The Platform may be accessed for informational purposes only or for availing Educational Services. Educational Services available on the Platform may include recorded lectures, live online or in-person classes, workshops, assessments, mentoring sessions, doubt-resolution sessions, learning resources, and other allied educational offerings (collectively referred to as the “Educational Services”).
Access to certain features, content, or Educational Services may be subject to registration, eligibility criteria, payment of applicable fees, or additional terms and policies, as may be specified by the Company from time to time.
Scope of Applicability
These Terms of Use / Terms of Service (“Terms”) govern, without limitation:
(a) access to, browsing of, and use of the Platform;
(b) enrolment in, access to, and consumption of the Educational Services;
(c) creation, maintenance, and operation of user accounts;
(d) access to and use of content, study materials, assessments, learning tools, and other resources made available on the Platform; and
(e) all interactions, communications, and transactions between users and FinTree conducted on or through the Platform.
These Terms apply to all users accessing or using the Platform from India or any other jurisdiction, subject to applicable local laws.
Acceptance and Binding Effect
By:
- accessing, visiting, or browsing the Platform;
- creating or maintaining a user account;
- enrolling in or participating in any course, program, or Educational Service;
- making any payment on or through the Platform; or
- otherwise accessing or using any part of the Platform or Services,
you expressly acknowledge that you have read, understood, and agreed to be legally bound by these Terms, together with the Privacy Policy and any other policies, guidelines, or notices referenced herein or made available on the Platform from time to time (collectively, the “FinTree Policies”).
These Terms constitute a legally binding and enforceable agreement between you and FinTree in accordance with the provisions of applicable laws and regulations.
If you do not agree to these Terms or any part thereof, you must immediately discontinue access to and use of the Platform and the Educational Services.
Your acceptance of these Terms shall be deemed to occur through electronic means, including but not limited to click-wrap, browse-wrap, in-app confirmations, or continued access to or use of the Platform. Such electronic assent shall have the same legal validity and enforceability as a physical signature in accordance with the Information Technology Act, 2000 and applicable rules made thereunder.
FinTree reserves the right, at its sole discretion, to modify, amend, update, or replace these Terms, in whole or in part, at any time.
Any such modification shall become effective immediately upon posting the revised Terms on the Platform, unless otherwise stated. Your continued access to or use of the Platform after such posting shall constitute deemed acceptance of the modified Terms.
FinTree’s Platform uses cookies and similar technologies to enhance your user experience, analyze Platform usage, and deliver personalized content and advertising. Cookies are small data files placed on your device that help remember your preferences and enable essential Platform functions. By using the Platform, you consent to our use of cookies as described in our Privacy Policy. You can manage or disable cookies through your browser settings, but please note that some features of the Platform may not function properly if cookies are disabled.
User Eligibility & Age Restrictions
Access to and use of the Platform and Educational Services is available only to individuals who are legally capable of entering into a binding contract under the laws applicable to them.
By accessing or using the Platform, you represent and warrant that:
- you are at least eighteen (18) years of age, or the age of majority under the laws of your jurisdiction, whichever is higher; and
- you are legally competent to enter into and be bound by these Terms.
If you are below the age of eighteen (18) years or the age of majority applicable in your jurisdiction, you may access or use the Platform only with the involvement, supervision, and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf and assumes full responsibility for:
- your access to and use of the Platform;
- all activities conducted through your account; and
- any payments, charges, or liabilities incurred.
FinTree does not knowingly permit minors to create independent user accounts or make payments without valid parental or guardian consent. FinTree may, at its discretion, require age verification, parental consent, or proof of legal capacity, and may restrict, suspend, or terminate access to the Platform or Educational Services if such verification is not provided or is found to be inaccurate.
FinTree reserves the right to deny, restrict, suspend, or terminate access to the Platform or Educational Services where a user does not meet the eligibility requirements set out herein or has provided false, misleading, or incomplete information regarding age or legal capacity.
Account Registration, Credentials & Security
To access certain features, content, or Educational Services on the Platform, you may be required to create and maintain a user account. You agree to provide true, accurate, current, and complete information during registration and to keep such information updated at all times.
You are solely responsible for:
- maintaining the confidentiality of your login credentials, including usernames, passwords, and any authentication information;
- all activities conducted through your account, whether or not authorised by you; and
- ensuring that your use of the Platform complies with these Terms and applicable laws.
You agree not to:
- share your account credentials with any third party;
- permit any other person to access or use your account; or
- use another user’s account without authorisation.
You must immediately notify FinTree of any unauthorised access to or use of your account, or any other breach of security. FinTree shall not be liable for any loss, damage, or unauthorised activity arising from your failure to safeguard your account credentials or to promptly notify FinTree of a security breach.
FinTree reserves the right to:
- implement reasonable security measures, including authentication protocols and access controls;
- suspend, restrict, or terminate your account, or require you to reset credentials, if it reasonably believes that your account has been compromised, misused, or accessed in violation of these Terms; and
- refuse registration or cancel accounts at its discretion, subject to applicable law.
Each user may maintain only one account, unless expressly permitted by FinTree in writing. Accounts are personal, non-transferable, and non-assignable.
Payments, Fees & Refunds
Fees and Pricing
Access to certain Educational Services on the Platform may be subject to payment of fees and any other terms and conditions, as displayed on the Platform at the time of enrolment or purchase. All fees are:
- stated in the applicable currency;
- exclusive of applicable taxes, duties, or levies unless expressly stated otherwise; and
- subject to change at FinTree’s discretion prior to purchase.
You agree to pay all applicable fees in full at the time of enrolment or purchase using the payment methods made available on the Platform. FinTree reserves the right to refuse or cancel any order or transaction in the event of suspected fraud, unauthorised activity, or pricing errors.
Payment Processing
Payments made on the Platform may be processed through third-party payment gateways or service providers. FinTree does not control and shall not be responsible for any errors, delays, failures, or unauthorised actions attributable to such third-party payment processors.
By making a payment, you authorise FinTree and its payment service providers to charge the applicable fees using your selected payment method and to take such steps as are reasonably necessary to complete the transaction.
Refunds and Cancellations
Except as expressly stated on the Platform or under a specific refund policy applicable to a particular course or program, all fees paid are non-refundable and non-transferable.
Where a refund is permitted:
- it shall be processed in accordance with the refund terms disclosed at the time of purchase;
- it may be subject to deductions for administrative charges which can range from 10% - 50%, taxes, or third-party payment gateway fees; and
- it shall be issued to the original payment method within a reasonable period, subject to the policies of the payment service provider.
No refunds shall be provided for:
- partial attendance, non-attendance, or early withdrawal from a course or program;
- failure to complete a course, assessment, or program;
- dissatisfaction with learning outcomes or results; or
- inability to access the Platform due to user-side technical issues, including internet connectivity, device compatibility, or software limitations.
Course Extension and Access Validity Policy
Course Extension and Access Validity Policy
Applies to all CFA Level 1, 2 and 3 enrollments, and to Combined Packages, for all online and offline students. By enrolling with FinTree Education Pvt. Ltd., you agree to the terms set out below. This policy supersedes all previously published extension policies, including any level-specific extension fee schedules.
1. Definitions
• Enrollment Date: the date the student’s fee payment is received and the course is activated.
• Course Expiry Date: the date the student’s originally purchased access period ends.
• Current Package Price: the price, at the time of the request, of the batch/package matching the exam window or duration the student is moving to.
• Proof of Registration (POR): a valid CFA Institute exam registration confirmation naming the student and the exam window applied for. Submitting POR where required is mandatory — failure to do so may result in deactivation of LMS access as set out in Section 6.
• Extension: additional LMS access requested after the first 60 days of enrollment, or after the Course
Expiry Date, as governed by Sections 4 and 5.
• Package: any individual CFA Level 1, 2, or 3 course offered by FinTree. Combined Package: a
bundled enrollment covering more than one CFA/FRM level, governed additionally by Section 9.
2. Course Access, Pause, and Non-Completion
• Once a course is activated, FinTree is not responsible for whether a student actually watches or completes the course content. A student’s later claim that they did not watch, or did not have time to watch, the content is not valid grounds for an Extension, a Pause, or a refund of any kind — all such requests remain governed exclusively by the timelines and conditions set out in this policy.
• A student may request to Pause their course access at any point before 50% of their original Course Validity Period (the period from Enrollment Date to Course Expiry Date) has elapsed. Once more than 50% of that period has elapsed, no Pause request will be accepted.
• A Pause may run for a maximum of 6 months. The Course Expiry Date is pushed back by the exact number of days the course was actually paused, so no purchased validity is lost.
• If the student does not request to resume earlier, access resumes automatically at the end of the 6- month Pause period — a Pause cannot be left open indefinitely.
• A Pause may be used once per enrollment, does not require Proof of Registration, and does not consume the one-time Extension allowance in Section 6.
3. Within 60 Days of Enrollment — Exam Window Change
• A student may switch their target exam window within 60 calendar days of the Enrollment Date.
• Only the difference between the price already paid and the Current Package Price of the new window is payable — no separate extension fee.
• Access validity is extended to match the standard validity of the newly selected window’s batch.
• Proof of Registration for the new window is required. This does not use up the one-time Extension allowance in Section 6.
Example: A student pays fees in August 2026 for the May 2027 exam window. By the end of September
2026 (within 60 days), they feel the timeline is too tight and ask to move to the August 2027 window instead.
They pay only the difference between the May 2027 and August 2027 batch prices, and their access now runs through the August 2027 window.
4. After 60 Days, Before Course Expiry — Extension
Once more than 60 days have passed since the Enrollment Date, and the course has not yet expired, a student may request an Extension. This structure applies uniformly across CFA Level 1, 2, and 3, and replaces any previously published level-specific extension fee schedule.
Extension Policy
• 3 Months / Immediate Exam Window
- Fee: 20% of Current Package Price
- Proof of Registration: Required
• 6 Months / Next Exam Window
- Fee: 40% of Current Package Price
- Proof of Registration: Required
• 9 Months / Second Subsequent Exam Window
- Fee: 60% of Current Package Price
- Proof of Registration: Required
• More Than 9 Months
- Fee: 15% Flat Discount, treated as a fresh enrollment
- Proof of Registration: Not Required
Example: A student enrolled in August 2026, with access running until February 2027. In December 2026 — more than 60 days after enrollment, but before expiry — they request a 6-month Extension. They pay 40% of the Current Package Price and submit Proof of Registration for the new window. If they instead ask for a 12-month Extension, they pay the prevailing package price less 15%, and no Proof of Registration is needed.
5. After Course Expiry
The same fee structure as Section 4 continues to apply for six months after the Course Expiry Date. Beyond that point, only a discounted resubscription is available:
Extension Request Policy
• Request Made Within 6 Months of Course Expiry Date
- Fee: Same as Section 4 — 20% / 40% / 60% based on extension duration, or 15% flat discount if the extension is for more than 9 months.
- Proof of Registration: Required for 3/6/9-month requests; not required for requests over 9 months.
• Request Made More Than 6 Months After Course Expiry Date
- Fee: 15% flat discount, treated as a fresh resubscription.
- Proof of Registration: Not Required.
Example: The same student’s course expires end-February 2027. If they return in April 2027 (within 6 months of expiry) and request a 3-month Extension, they pay 20% of the Current Package Price with Proof of Registration. If instead they return in November 2027 (more than 6 months after expiry), they simply resubscribe to the course at 15% off the prevailing price, with no Proof of Registration needed.
6. General Safeguards
• A student may use the tiered Extension in Section 4 or 5 only once per enrollment. A further request after that is treated as the resubscription described above, at the price then prevailing (with the 15% discount, without POR, as set out above).
• A student who has already paid for a shorter Extension may, before that Extension period is finalised, request to convert it into a longer Extension duration, including the more-than-9-months tier. The fee already paid is credited against the new tier’s fee, and only the balance is payable. This conversion is treated as a single Extension for the purposes of the one-time allowance above, and if the new tier is the more-than-9-months tier, no Proof of Registration is required for the converted request.
Example: A student takes a 6-month Extension in August 2026, paying 40% of the Current Package Price, with a Proof of Registration deadline of end-November 2026 for the February 2027 window. Unable to meet that deadline, the student instead asks to shift their target window to August 2027 — a full 12 months from the original Enrollment Date. This now falls in the more-than-9-months tier (15% discount, i.e. 85% of Current Package Price, no Proof of Registration required). The 40% already paid is credited against the 85% due, so the student pays only the remaining 45%.
• Wherever Proof of Registration is required, it must be submitted within 10 calendar days of the request. If not submitted in time, the request is treated as a resubscription at the price then prevailing, and any extension fee already paid is adjusted against that amount; continued non-submission may result in deactivation of LMS access.
• All extension and window-change fees are non-refundable and non-transferable, regardless of whether the student later sits for, postpones, or cancels the exam.
• Extensions are not guaranteed by payment alone. Every request remains subject to FinTree’s review to confirm it is genuine, complete, and consistent with this policy — FinTree may decline a request that is fraudulent, incomplete, or inconsistent with these terms.
7. Program Upgrades and Downgrades
• To upgrade to a higher package, contact the Admin Team at inquire@fintreeindia.com. Approval of an upgrade is solely at the Admin Team’s discretion.
• The upgrade fee is the difference between the price the student originally paid and the Current Package Price of the upgraded package.
• Downgrading a program, or reducing the validity of a program already purchased, is not available under any circumstances.
8. Level 3 — Specialised Pathways
8.1 Pathway Selection
• A pathway need not be chosen at the time of purchase. Students may inform FinTree by email of their chosen pathway any time before their course ends.
• Once a pathway is selected, it cannot be changed while the course remains active.
8.2 Pathway Change on Extension
• Any desired pathway change must be specified at the time an Extension is requested under Section 4 or 5.
• Once an Extension is granted, no further pathway changes are permitted for the remainder of that enrollment.
8.3 Complimentary Cross-Pathway Access
• A current student who has appeared for their exam may request one month of complimentary access to a different specialised pathway, at no extra cost.
• The request must be made after the exam and before the result is declared, supported by proof of the CFA exam appointment letter, and must state a valid reason by email. Acceptance of the request is at FinTree’ discretion.
8.4 Extension Charges
• Extension charges for Level 3 enrollments, including Specialised Pathways, are governed by the standard Extension fee structure in Sections 4 and 5 of this policy — there is no separate Level 3 rate.
9. Combined Packages
9.1 Package Validity
• Combined package validity commences on the date of activation and runs for the duration stated at purchase. Unused validity does not carry forward beyond that period.
• Combined package validity represents the overall validity of the package, not simultaneous access to all included levels; access to individual levels is governed by the sequential unlock rules in Section
9.2.
9.2 Sequential Level Access
• Access is granted one CFA/FRM level at a time. Simultaneous access to multiple levels is not permitted under any circumstances.
• FinTree determines the timing and process for unlocking each subsequent level.
9.3 Level Unlock Requirements
• Access to the next level is granted only after the student completes the previous exam and follows the prescribed unlock process.
• FinTree may request exam registration proof, result proof, or other supporting documentation before granting access to the next level.
9.4 Anti-Piracy and Content Protection
• Sequential access protects FinTree’s intellectual property and prevents unauthorized sharing, duplication, piracy, or misuse of course content.
• Suspected misuse, account sharing, unauthorized distribution, or abnormal usage may result in immediate suspension or termination of access without refund.
9.5 Financial Modelling Complimentary Course
• Any Financial Modelling course included within a combined package is complimentary, and may carry its own separate validity period, activation requirements, and usage restrictions.
• This complimentary benefit has no cash value and cannot be exchanged, transferred, extended, or refunded.
9.6 Extension Policy
• Extensions for combined packages, if permitted, are governed by the Extension rules in Sections 4 and 5 of this policy, as prevailing at the time of the request.
• Fee amounts and discount rates under this policy may be revised at any time in line with Section 11; approval of any extension request remains solely at FinTree’s discretion.
9.7 Deferral and Exam Changes
• Students may defer, postpone, or change their own exam plans at their discretion. FinTree is not liable for the consequences of a student’s own exam-related decisions, and package validity continues on its original schedule regardless of such changes.
9.8 Non-Transferability
• Combined packages are strictly personal and non-transferable. Course access, login credentials, study materials, and associated benefits cannot be assigned, shared, sold, or transferred to any other individual.
9.9 No Refund Policy
• All purchases made through FinTree, including combined packages, standalone packages, and individual courses are final. Fees paid are non-refundable under any circumstances, including exam deferrals, personal commitments, medical situations, employment changes, dissatisfaction, or non-utilisation of the course.
9.10 Inactive Accounts
• FinTree reserves the right to deactivate accounts that remain inactive for an extended period. Reactivation, where permitted, is subject to FinTree’s prevailing policies and verification requirements.
10. Payment Terms
• Two-part payment is available only on specified products, as stated at the time of purchase, and must be completed within the timeline communicated in writing by FinTree.
• If a payment instalment is missed, FinTree reserves the right to block access to the course; access is reinstated only upon receipt of the full outstanding balance.
• Access granted against partial payment remains conditional on completing the full package fee within the prescribed timeline; failure to do so may result in suspension, cancellation, or termination of access without refund.
• If dues remain unpaid for more than 12 months from the date of the last reminder, the enrollment is treated as null and void, and the student must repurchase the course at the price then prevailing.
11. Policy Modification
• FinTree reserves the right to modify, amend, discontinue, or replace any feature, fee, discount, validity period, or term associated with this policy, at its sole discretion.
• Fee amounts, percentages, and discount rates under this policy may be revised at any time without individual notice, and take effect upon publication on FinTree’s official website.
12. Final Authority and Interpretation
• FinTree’s interpretation of this policy and any related terms is final and binding in all cases.
• Any exception, waiver, concession, or special approval granted in an individual case, under any level or package type, does not constitute a precedent for future requests.
13. Jurisdiction
• Any disputes arising from this policy are subject to the exclusive jurisdiction of the courts of Pune, for all online and offline students.
Chargebacks and Disputes
You agree not to initiate chargebacks or payment disputes with your bank or payment provider without first contacting FinTree to seek resolution. Unauthorised chargebacks may result in suspension or termination of your account and access to the Platform, without prejudice to FinTree’s legal rights.
Taxes
You are responsible for payment of all applicable taxes, duties, or governmental charges arising from your purchase or use of the Educational Services, as may be required under applicable laws.
Acceptable Use, Prohibited Conduct & Limited Licence
Limited Licence
Subject to your compliance with these Terms, FinTree grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable licence to access and use the Platform and the Educational Services solely for your personal, non-commercial use and in accordance with these Terms.
This licence is valid only for the duration of the specific course or program in which you are enrolled, including any prescribed access period or completion timelines. Upon expiry of such timelines, or upon termination or suspension of your account for any reason whatsoever, FinTree may, at its sole discretion and without prior notice, revoke or suspend your access to the Platform and the Educational Services.
Upon expiry of the applicable course or program, or upon termination or suspension of your account for any reason whatsoever, all rights and licences granted to you under these Terms shall immediately and automatically stand revoked.
You shall thereafter have no right whatsoever to access, use, download, retain, store, copy, reproduce, distribute, transfer, transmit, share, display, perform, exploit, or rely upon the Platform, the Educational Services, or any study materials, recordings, videos, content, or other resources made available by FinTree, whether in digital or physical form, whether previously downloaded, stored, printed, saved, or otherwise retained, and whether for personal use or for any other purpose whatsoever
Upon such expiry, termination, or suspension, you shall:
- Immediately cease all use of the Platform and the Educational Services;
- Permanently delete and destroy all digital copies of FinTree’s content, including downloaded videos, recordings, PDFs, notes, or other materials stored on any device, cloud storage, or backup system; and
- Destroy all physical copies, printouts, handwritten notes, or any other tangible reproductions derived from FinTree’s content.
You shall not retain, archive, transfer, or make available any such content in any manner whatsoever, whether directly or indirectly.
You expressly acknowledge that no ownership or proprietary rights are transferred to you under these Terms.
Any continued possession, storage, transfer, dissemination, or use of FinTree’s content after expiry, termination, or suspension shall constitute unauthorised use and infringement of FinTree’s intellectual property rights, irrespective of whether such content was obtained during the valid licence period.
Without prejudice to FinTree’s other rights and remedies under law or equity, any breach of this clause shall entitle FinTree to:
- Immediate injunctive relief, including interim and permanent injunctions, to restrain unauthorised access, use, retention, or dissemination of its content;
- Recovery of actual damages, statutory damages, and/or equitable relief, as may be determined by a competent court or authority; and
- Recovery of costs and expenses, including reasonable legal fees, incurred in enforcing FinTree’s rights.
You acknowledge that unauthorised retention or use of FinTree’s proprietary content may cause irreparable harm for which monetary compensation alone may be inadequate.
The obligations under this clause shall survive the expiry, termination, or suspension of your account and shall continue to bind you notwithstanding cessation of access to the Platform or Educational Services.
Acceptable Use
You agree to use the Platform and Educational Services:
- only for lawful purposes;
- in a manner consistent with these Terms and applicable laws;
- without infringing the rights of FinTree or any third party; and
- without interfering with the operation, security, or integrity of the Platform.
Prohibited Conduct
You agree that you shall not, directly or indirectly:
- copy, reproduce, distribute, modify, adapt, translate, display, publish, transmit, sell, license, rent, lease, or otherwise exploit any part of the Platform or Educational Services, except as expressly permitted under these Terms;
- download, record, screen-capture, scrape, archive, or create derivative works from any content, lectures, materials, or assessments made available on the Platform, whether in whole or in part, without prior written consent;
- share, transfer, resell, sublicense, or permit third-party access to your account, login credentials, or purchased Educational Services;
- use the Platform or content for any commercial, competitive, or unlawful purpose;
- attempt to circumvent, disable, or interfere with security features, access controls, digital rights management (DRM), paywalls, or usage restrictions;
- introduce viruses, malware, or other harmful code, or engage in activities that disrupt, damage, or impair the Platform;
- reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying structure of the Platform or any related technology;
- misrepresent your identity, impersonate any person or entity, or falsely claim affiliation with FinTree;
- engage in abusive, harassing, defamatory, obscene, misleading, or otherwise objectionable conduct on or through the Platform; or
- violate any applicable law, regulation, or third-party rights.
Enforcement
FinTree reserves the right, at its sole discretion and without prior notice, to restrict, suspend, or terminate your access to the Platform or Educational Services, remove content, and take appropriate legal action if it reasonably believes that you have violated these Terms or engaged in prohibited conduct.
Intellectual Property Ownership
All rights, title, and interest in and to the Platform, the Educational Services, and all content made available thereon, including but not limited to software, source code, object code, databases, user interfaces, designs, text, graphics, images, audio, video, lectures, recordings, study materials, assessments, methodologies, trademarks, logos, brand names, and other proprietary information (collectively, the “FinTree Content”), are owned by or validly licensed to FinTree and are protected by applicable intellectual property laws, including copyright, trademark, patent, and trade secret laws.
Except for the limited licence expressly granted under these Terms, no rights are transferred or granted to you in respect of any FinTree Content. You acknowledge and agree that:
- all intellectual property rights in the Platform and Educational Services vest exclusively with FinTree and/or its licensors;
- your use of the Platform does not confer any ownership or proprietary rights; and
- any unauthorised use of FinTree Content may result in civil and/or criminal liability under applicable laws.
Any trademarks, service marks, trade names, logos, or brand identifiers displayed on the Platform are proprietary to FinTree or their respective owners. Nothing contained in these Terms shall be construed as granting, by implication, estoppel, or otherwise, any licence or right to use any such intellectual property without the prior written consent of FinTree or the relevant rights holder.
You shall not copy, reproduce, distribute, modify, create derivative works from, publicly display, transmit, sell, license, or otherwise exploit any FinTree Content, in whole or in part, except as expressly permitted under these Terms or with FinTree’s prior written consent.
If the Platform permits users to submit or upload any content, materials, feedback, or communications, such submissions shall be governed by the applicable content or feedback policy, and nothing herein shall be deemed to transfer ownership of FinTree’s intellectual property to users.
You agree not to, and shall not assist or enable others to:
- circumvent, disable, or otherwise interfere with any security features or technological measures implemented on the Platform or in the Educational Services to protect FinTree Content;
- use any automated systems, bots, scrapers, or other methods to extract, copy, or collect data or content from the Platform in violation of these Terms or applicable laws;
- engage in plagiarism by presenting FinTree’s content, courses, or materials as your own work or in any manner that violates academic or professional integrity standards;
- share, resell, or redistribute access credentials, course materials, or Educational Services to unauthorized third parties;
- distribute or disclose any personally identifiable information, confidential information, or proprietary content obtained from the Platform without proper authorization;
- engage in any activity that compromises the privacy or security of other users or the Platform, including unauthorized access to data, accounts, or networks.
Violation of any of these provisions may result in immediate termination of your access and legal action to the fullest extent permitted by law.
User-Generated Content & Feedback Licence
User-Generated Content
Where the Platform permits you to submit, upload, post, transmit, or otherwise make available any content, materials, data, text, images, audio, video, assignments, responses, messages, comments, questions, or other information (collectively, “User Content”), you represent and warrant that:
- you own or have all necessary rights, permissions, and consents to submit such User Content;
- the submission and use of such User Content does not infringe any intellectual property, privacy, publicity, or other rights of any third party; and
- such User Content complies with these Terms and applicable laws.
You retain ownership of your User Content. However, by submitting User Content on or through the Platform, you grant FinTree a worldwide, perpetual, irrevocable, royalty-free, non-exclusive, transferable, and sublicensable licence to host, store, use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly display, and perform such User Content, solely for the purposes of:
- operating, providing, maintaining, improving, and promoting the Platform and Educational Services;
- internal analysis, quality control, and research;
- complying with legal, regulatory, or contractual obligations; and
- resolving disputes or enforcing these Terms.
FinTree shall have no obligation to review, monitor, or use any User Content and does not endorse any User Content submitted by users.
Feedback
If you provide any suggestions, ideas, feedback, reviews, ratings, or recommendations relating to the Platform or Educational Services (collectively, “Feedback”), you acknowledge and agree that:
- such Feedback is provided voluntarily and without expectation of compensation;
- FinTree may freely use, implement, adapt, and exploit such Feedback for any purpose, including commercial purposes, without restriction or obligation to you; and
- FinTree shall own all rights, title, and interest in any improvements, enhancements, or developments derived from such Feedback.
Content Moderation and Removal
FinTree reserves the right, but not the obligation, to review, monitor, moderate, remove, or disable access to any User Content at its discretion, including where it reasonably believes such content:
- violates these Terms or applicable laws;
- infringes third-party rights;
- is misleading, unlawful, offensive, or inappropriate; or
- may expose FinTree or users to legal or reputational risk.
Suspension & Termination
FinTree reserves the right, at its sole discretion and without liability, to restrict, suspend, or terminate your access to the Platform, your user account, or any Educational Services, in whole or in part, with or without prior notice, if FinTree reasonably believes that:
- you have violated or breached these Terms, any FinTree Policies, or applicable laws;
- you have engaged in fraudulent, unlawful, abusive, or harmful conduct;
- your use of the Platform poses a security, operational, legal, or reputational risk to FinTree or other users;
- information provided by you is false, misleading, inaccurate, or incomplete; or
- such action is required to comply with legal, regulatory, or governmental orders.
FinTree may also suspend or terminate access to specific features, content, courses, or Educational Services for operational, technical, maintenance, or business reasons, with or without notice.
Upon suspension or termination:
- your right to access or use the Platform and Educational Services shall immediately cease;
- any licences granted to you under these Terms shall automatically terminate;
- FinTree may disable or delete your account and associated data in accordance with its data retention policies and applicable law; and
- any outstanding payment obligations shall remain payable and due.
Unless expressly stated otherwise under an applicable refund policy, no refunds, credits, or reimbursements shall be provided for any suspension or termination resulting from your breach of these Terms.
Termination of these Terms shall not affect any rights or obligations which by their nature are intended to survive, including provisions relating to intellectual property, limitation of liability, indemnity, governing law, and dispute resolution.
Disclaimer of Warranties
The Platform and the Educational Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, statutory, or otherwise.
To the fullest extent permitted under applicable law, FinTree disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, uninterrupted access, error-free operation, or suitability of the Platform or Educational Services for any specific objective or outcome.
FinTree does not guarantee or warrant any particular learning outcomes, academic results, certification, professional qualification, or commercial benefit from use of the Platform or Educational Services. Any reliance on the Platform or Educational Services is at your own risk.
FinTree does not warrant or represent that:
- the Platform or Educational Services will be uninterrupted, timely, secure, or error-free;
- any defects, errors, or omissions will be corrected;
- the Platform or any servers, networks, or systems are free from viruses, malware, or other harmful components; or
- use of the Platform will result in any specific outcome.
Third-Party Services and Infrastructure
The Platform may rely on or integrate with third-party service providers, including but not limited to cloud hosting services, content delivery networks, video-conferencing tools, learning management systems, payment gateways, analytics providers, communication tools, and other technology or infrastructure providers.
FinTree does not control and shall not be responsible or liable for:
- the availability, performance, security, or reliability of such third-party services;
- any interruption, delay, failure, data loss, or breach arising from or attributable to such third-party providers; or
- any acts, omissions, or defaults of such third-party service providers.
Your use of third-party services accessed through the Platform may be subject to separate terms and policies imposed by such third parties, and FinTree makes no representations or warranties with respect to such services.
No Professional or Regulated Advice
Any content or Educational Services relating to financial education, investment awareness, or allied topics are provided solely for educational and informational purposes and do not constitute professional, financial, investment, legal, or regulatory advice. Users should seek independent professional advice before making any decisions based on such content.
Third-Party Trademarks and Disclaimers
FinTree is a CFA Institute Prep Provider. Only CFA Institute Prep Providers are permitted to make use of CFA Institute copyrighted materials which are the building blocks of the exam. FinTree is also required to create / use updated materials every year and this is validated by CFA Institute.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FINTREE EDUCATION PRIVATE LIMITED, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- ERRORS, MISTAKES, OR INACCURACIES IN USER CONTENT OR ANY OTHER CONTENT AVAILABLE ON OR THROUGH THE PLATFORM;
- PERSONAL INJURY, PROPERTY DAMAGE, OR ANY OTHER LOSS ARISING FROM YOUR ACCESS TO OR USE OF THE PLATFORM OR EDUCATIONAL SERVICES;
- UNAUTHORIZED ACCESS TO OR USE OF SECURE SERVERS OR ANY PERSONAL, FINANCIAL, OR OTHER INFORMATION STORED THEREIN;
- INTERRUPTION, CESSATION, OR FAILURE OF TRANSMISSION TO OR FROM THE PLATFORM;
- ANY BUGS, VIRUSES, TROJAN HORSES, OR OTHER HARMFUL COMPONENTS THAT MAY BE TRANSMITTED TO OR THROUGH THE PLATFORM BY ANY THIRD PARTY;
- ERRORS OR OMISSIONS IN ANY USER CONTENT OR OTHER CONTENT, OR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE PLATFORM;
- ANY CONDUCT OR CONTENT OF THIRD PARTIES ON OR THROUGH THE PLATFORM, INCLUDING DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT;
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT FINTREE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WE UNDERSTAND THAT IN SOME JURISDICTIONS, CERTAIN WARRANTIES, DISCLAIMERS, OR CONDITIONS MAY BE IMPLIED BY LAW AND CANNOT BE EXCLUDED OR LIMITED. TO THE EXTENT THAT THIS IS APPLICABLE IN YOUR JURISDICTION, FINTREE’S LIABILITY UNDER SUCH WARRANTIES OR CONDITIONS SHALL BE LIMITED, AT FINTREE’S SOLE DISCRETION, TO EITHER:
- SUPPLYING THE PLATFORM OR EDUCATIONAL SERVICES AGAIN; OR
- THE COST OF HAVING THE PLATFORM OR EDUCATIONAL SERVICES SUPPLIED AGAIN.
THE PLATFORM IS CONTROLLED AND OPERATED BY FINTREE FROM ITS FACILITIES IN INDIA. FINTREE MAKES NO REPRESENTATION THAT THE PLATFORM OR EDUCATIONAL SERVICES ARE APPROPRIATE OR AVAILABLE FOR USE IN OTHER LOCATIONS. IF YOU ACCESS OR USE THE PLATFORM FROM OUTSIDE INDIA, YOU DO SO VOLUNTARILY AND ARE RESPONSIBLE FOR COMPLIANCE WITH LOCAL LAWS.
THE TOTAL AGGREGATE LIABILITY OF FINTREE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM OR THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, TO FINTREE FOR ACCESS TO OR USE OF THE SPECIFIC EDUCATIONAL SERVICES GIVING RISE TO SUCH LIABILITY IN THE SIX (6) MONTHS PRECEDING THE EVENT.
Confidentiality and Data Privacy
Your privacy and the confidentiality of your information are important to FinTree. By using the Platform and Services, you acknowledge and agree that any personal data you provide will be collected, processed, stored, and used in accordance with FinTree’s Privacy Policy, which is incorporated by reference into these Terms.
The Privacy Policy explains in detail:
- the types of personal information collected;
- how such information is used, shared, and protected;
- your rights regarding your personal data; and
- the security measures FinTree employs to safeguard your information.
You agree to review the Privacy Policy periodically to stay informed of any updates or changes.
FinTree commits to maintaining reasonable administrative, technical, and physical safeguards designed to protect the confidentiality, integrity, and availability of your personal information in accordance with applicable data protection laws and regulations.
You shall keep confidential any non-public information obtained through your use of the Platform and shall not disclose such information to any third party unless required by law or with FinTree’s prior written consent.
If you have any questions or concerns regarding your privacy or data security, please refer to the Privacy Policy or contact FinTree through the communication channels provided on the Platform.
Indemnity
You agree to indemnify, defend, and hold harmless FinTree, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, demands, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or related to:
- your use of or access to the Platform and Educational Services;
- your violation or breach of these Terms or any FinTree Policies;
- your violation of any applicable law, regulation, or third-party right, including intellectual property rights or privacy rights;
- any User Content you submit, upload, or transmit on or through the Platform;
- your negligent or willful misconduct; or
- any dispute or issue arising between you and other users of the Platform.
FinTree reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate fully with FinTree in the defence of any such claim.
This indemnity obligation will survive the termination or expiration of these Terms.
Force Majeure
FinTree shall not be liable for any failure or delay in performing its obligations under these Terms to the extent such failure or delay is caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, governmental actions, epidemics or pandemics, civil unrest, strikes, power outages, floods, fires, unusually severe weather, or any other similar force majeure events.
Compliance with Information Technology Laws
These Terms are published in accordance with applicable provisions under the Information Technology (Intermediary Guidelines) Rules, 2011, and other relevant laws.
You agree not to post or transmit any information or content that is malicious, defamatory, obscene, pornographic, unlawful, or otherwise objectionable, including but not limited to material that:
- infringes intellectual property rights or other proprietary rights;
- is harmful, threatening, abusive, hateful, or discriminatory; or
- attacks or maligns any individual, group, institution, or entity.
FinTree reserves the right to remove any such content without prior notice. The IP address of all posts and submissions may be recorded to assist in enforcing these policies and complying with legal obligations.
Electronic Communications
By using the Platform and Services, you consent to receive electronic communications from FinTree, including notices, agreements, disclosures, and other communications related to your use of the Platform.
These communications may be provided via email, push notifications, SMS, or by posting on the Platform.
You agree that all agreements, notices, disclosures, and other communications that FinTree provides electronically satisfy any legal requirement that such communications be in writing.
Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
Any dispute, controversy, or claim arising out of or relating to these Terms, including the breach, termination, or validity thereof, shall be resolved as follows:
- The parties agree to resolve any such dispute exclusively through arbitration under the provisions of the Indian Arbitration and Conciliation Act, 1996, or any statutory modification or re-enactment thereof (“Arbitration Act”). The seat and venue of arbitration shall be Pune, Maharashtra, India. The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties. If the parties fail to agree on the arbitrator within 30 days from the notice of arbitration, the arbitrator shall be appointed in accordance with the Arbitration Act. The arbitration proceedings and award shall be conducted and rendered in the English language.
- Notwithstanding the arbitration clause, the parties agree that the courts in Pune, Maharashtra, India, shall have exclusive jurisdiction to entertain any action or proceeding arising out of or in connection with these Terms, to the extent such jurisdiction is necessary for the enforcement of the arbitration award or interim relief.
- You hereby irrevocably waive any objection to the venue or jurisdiction of the courts in Pune and agree not to seek to transfer or challenge jurisdiction in any other court or forum.
Severability, Notices, Access & Miscellaneous
If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severable and shall not affect the validity, legality, or enforceability of the remaining provisions.
Any notice required or permitted to be given under these Terms shall be in writing and sent to FinTree’s registered office address or communicated electronically as provided on the Platform.
Headings used in these Terms are for convenience and reference only and shall not affect the interpretation or construction of the provisions.
FinTree’s failure to enforce any right or remedy under these Terms shall not be deemed a waiver of such right or remedy nor prevent FinTree from enforcing it subsequently.
Nothing contained in these Terms shall be deemed or construed to create any partnership, joint venture, employment, agency, fiduciary, or representative relationship between FinTree and any user.
In the event of any inconsistency or conflict between these Terms and any additional or specific terms applicable to a particular course, program, service, or feature offered on the Platform, such specific terms shall prevail, unless expressly stated otherwise.
